Welcome to HabitUp ("we," "our," or "us"). By accessing or using our website located at https://habitup.io/ and our mobile or web applications (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

1. Description of Service

HabitUp is a software-as-a-service (SaaS) application designed to help users track habits, manage routines, and analyze personal progress (the "Service"). The Service is provided on an "as-is" and "as-available" basis.

2. Eligibility and Account Registration

You must be at least 14 years old (or the minimum legal age in your country) to use this Service.
To access certain features, you must register for an account. You agree to provide accurate, current, and complete information during registration.
You are solely responsible for safeguarding your account password and for any activities or actions under your account.

3. Subscriptions, Fees, and Payments

Our Order process is conducted by our Online Reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Billing: Certain parts of the Service are billed on a subscription basis ("Billing Period"). You will be billed in advance on a recurring and periodic basis depending on the type of subscription plan you select.
Price Changes: We reserve the right to modify subscription fees at any time. Any price changes will become effective at the end of the current Billing Period, and we will provide you with reasonable prior notice.
Cancellation: You may cancel your subscription at any time through your account settings. Your subscription will remain active until the end of the current paid billing cycle.

4. Acceptable Use Policy

You agree not to misuse the Service. Specifically, you agree not to:

Use the Service for any unlawful purposes or to promote illegal activities.
Attempt to reverse engineer, decompile, or disrupt the integrity or performance of the Service.
Use automated systems (bots, spiders, scrapers) to extract data from the Service without our express written permission.

5. Intellectual Property

The Service, including its original content, features, functionality, UI/UX design, and source code, is and will remain the exclusive property of Sudarev Aleksandr and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without our prior written consent.

6. User Content

You retain ownership of any data, text, or information that you submit or post to the Service ("User Content"). However, by submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to host, store, and process your data solely for the purpose of providing the Service to you.

7. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Sudarev Aleksandr, its founders, or suppliers be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Service.

8. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever, including without limitation if you breach the Terms.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of Georgia, without regard to its conflict of law provisions.

10. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
